| Introduction |
Welcome to AGTimuran. By using the services on the AG websites (eBay.com.my and other related websites where this agreement appears), you are agreeing to the following terms with AG, including those available by hyperlink, and the general principles for the websites of our subsidiaries and international affiliates. Before you may become a member of AG, you must read and accept all of the terms and conditions in, and linked to, this Terms of Service and the Privacy Policy. We strongly recommend that, as you read this Terms of Service, you also access and read the linked information. By accepting this Terms of Service you also agree that your use of some AG-branded websites or websites we operate may be governed by separate user agreements and privacy policies. The agreement that applies on any of our domains and subdomains is always the agreement that appears in the footer of each website. |
| Accepting the Terms |
In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms. You can accept the Terms by: (A) clicking to accept or agree to the Terms, where this option is made available to you by AG in the user interface for any Service; or (B) by actually using the Services. In this case, you understand and agree that AG will treat your use of the Services as acceptance of the Terms from that point onwards. | Using AG |
In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to AG will always be accurate, correct and up to date. You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from Malaysia or other relevant countries). You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by AG, unless you have been specifically allowed to do so in a separate agreement with AG. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services. You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services). Unless you have been specifically permitted to do so in a separate agreement with AG, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose. You agree that you are solely responsible for (and that AG has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which AG may suffer) of any such breach. |
| Privacy |
| We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the AG Privacy Policy. We view protection of users' privacy as a very important community principle. We store and process your information on computers located in the Malaysia that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. If you object to your Information being transferred or used in this way please do not use our services. |
| Liability |
| You will not hold AG responsible for other users' content, actions or inactions, or items they list. You acknowledge that we are not a traditional user. Instead, the sites are a venue to allow anyone to track, viewl, and buy just about anything, at anytime, from anywhere, in a variety of pricing formats and venues, such as stores and fixed price formats. We are involved in the actual transaction with buyers. We have control over and do guarantee the quality, safety or legality of items advertised, the truth or accuracy of products content or listings, the ability of users to sell view items, the ability of users to track for items, or that a user will actually complete a transaction. |
| Content |
When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, trademark, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. For the convenience of users, we may offer catalogues of stock images, descriptions and product specifications, which are provided by AG. While we try to offer reliable data, we cannot promise that the catalogues will always be accurate and up-to-date. If you choose to include catalogue content in your listings, you will be responsible for ensuring that your listings are accurate and do not include misleading information. You agree that you will not hold our catalogue providers responsible for inaccuracies in their catalogues. The catalogues may include copyrighted, trademarked or other proprietary materials. You may use the catalogues only for informational purposes and only in connection with your AG listings. You may not use catalogue content in a way that infringes or violates anyone's proprietary rights. |
| General |
| The Terms constitute the whole legal agreement between you and AG and govern your use of the Services (but excluding any services which AG may provide to you under a separate written agreement), and completely replace any prior agreements between you and AG in relation to the Services. |
